General

The domain name www.vandhanapolyplast.com (hereinafter referred to as "Website") is owned and operated by VandhanaPolyPlast (VPP) an entity affiliated with Vandhana International Pvt Ltd (VIPL) having its principle place of business at Plot No. 113, Sector -6A, IIE SIDCUL, Haridwar – 249402.

For the purpose of these terms and conditions, wherever the context so requires the term ‘You’/ ‘User’/ ‘End User’ shall mean any natural or legal person (including their representatives or affiliates) who (a) has visited the Website (b) registered on the Website. Any products or services provided by the Website which do not require registration do not absolve you of the contractual relationship established by these terms and conditions.

The Website enables the User to connect with the VPP and avail its services / products customised to their requirements and specifications.

These terms and conditions (hereinafter “Terms”) read together with the Privacy Policy available at the Website (“Privacy Policy”) govern your access to and use of the Website and the services made available thereon, and constitutes a legally binding agreement ( “Agreement”) between you and VPP. If you do not understand or agree to these Terms or the Agreement, you must refrain from using the Website or the services available thereon.

By visiting, viewing or otherwise using the Website and the services thereunder, you / User are thereby deemed to represent and warrant that you have read, understood and agreed to be bound by the Terms of this Agreement. Further, your use of the Website is an acknowledgement that you have reviewed these Terms and agrees to comply with the same and be legally bound thereby.

This Agreement supersedes all previous oral and written terms and conditions (if any) communicated to you. Irrespective of the use of the Website from any medium or device, including mobile, smart phone or tablet, the User is bound by this Agreement. This Agreement defines the terms and conditions under which you are allowed to use the Website and describes the manner in which VPP shall treat your account and the Information associated with it while you are registered with VPP.

The User acknowledges that these Terms are in electronic form and has the same force and effect as an agreement in writing.

Conditions Of Use

You must be 18 years of age or older to register, use the Services, or visit or use the Website in any manner. By registering, visiting and using the Website or accepting this Agreement, you represent and warrant that you are 18 years of age or older, and that you have the right, authority and capacity to use the Website and the Services available through the Website, and agree to and abide by this Agreement.

In cases, the User is accessing the website on behalf of a body corporate, such an End-User shall duly register herself / himself through the permission of such entity / body corporate and such entity / body corporate agrees to be responsible for the action of such End- User who uses the Website. The entity / body corporate shall enter into this Agreement on behalf of such End-User, and bind itself in accordance with all terms and conditions herein. The entity / body corporate also consents to the User Information being taken of such employee / representative as specified in the Privacy Policy.

Without limitation to the foregoing, in the event you are barred from undertaking legally binding obligations under the Indian Contract Act,1872, or are, for any reason, unable to provide Consent as per the SPDI Rules or as required hereunder, you are not eligible to register for, use or avail the services available on the Website.

Your use of the Website is under a license from us. Your license to use the Website is personal, revocable, non-assignable and non-exclusive. You, therefore may not use the Website for any commercial purpose.

The End-user shall not access the Services for purposes of monitoring their availability, performance or functionality, or for any other benchmarking or competitive purpose.

You are responsible for each mobile you access the website, including maintaining properly running compatible updated software, a suitable internet connection, and an appropriate firewall and virus scanning software. VPP will not be liable for your failure to update or use the Website in the appropriate manner. In the event you provide any false or inaccurate details or VPP has reasonable grounds to believe that the information provided by you is false, VPP reserves the right to suspend your account and /or discontinue the Services to you at its sole discretion. VPP does not accept any liability for the loss or damage sustained by you as a result of such false information provided by you

The User will not circumvent any encryption or otherwise gain access to Services for which the User has not been expressly granted the appropriate rights of access.

The User will not use the Services for or knowingly transmit to “VandhanaPolyPlast” or upload to any VPP site or network any illegal, improper or unacceptable material or use them for illegal, improper or unacceptable practices including without limitation the dissemination of any defamatory, fraudulent, infringing, abusive, lewd, obscene or pornographic material, viruses, trojan horses, time bombs, worms, or other harmful code designed to interrupt, destroy, or limit the function of any software, hardware or communications equipment, unsolicited mass email or other internet based advertising campaigns, privacy breaches, denial of use attacks, spoofing or impersonation.

Intellectual Property

The Design & Innovation Services and Specific Products designed, produced and manufactured from such design and innovation collaborative services are the trademark(™) of Vandhana International Pvt. Ltd. The design, shape of these specific products are new and innovative, not seen in the relevant industry space in India, have been granted design patents and are copyrighted. They are protected by applicable intellectual property laws (including but not limited to copyright, trademark and patents)

A User may browse through the whole Website without any subscription. They have easy access to the technology, products pages etc. The information displayed on the Website may be proprietary in nature. Furthermore, a User must bear in mind that all cups/containers with decorative elements i.e. sleeved cups / containers and printed cups/containers the imagery and artwork are the copyright and trademark property of the customers of VPP/ VIPL and protected by the trademarks, copyrights granted to those clients/ customers etc.

Any other reproduction of any of the products, content, services in any form or by any means is forbidden without the written permission of VPP. Without limiting the generality of the foregoing, the User will not:

  • Record and re-transmit any of the products, services, content etc over any network (including any local area network), except as otherwise stated above
  • Use any products, services, content etc in any timesharing, service bureau, bulletin board or similar arrangement or public display;
  • Post any products, services, contentetc to any other online service (including bulletin boards or the Internet);
  • Sublicense, lease, sell, offer for sale or assign the products, services, content etc; or
  • Use VPP/ VIPL's name or any excerpts from the products, services, content etc in the promotion of its own products or services.

Users

Users are authorized to browse the VPP website and go through the products, technology pages and other content. Only for the purpose of raising a query, requiring assistance, seeking clarification, wanting to collaborate with VPP etc they must be fill up the Contact Us page information providing basic personal information.

Users must bear in mind the IP of our customers and clients and any violation in that regard will merit legal action from those companies/clients/ customers.

You agree to use the Website, only for the purposes that are permitted by (a) this Agreement, and (b) any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions.

You agree not to access (or attempt to access) the Website or services by any means other than through the interface that is provided by VPP. You shall not use any deep-link, robot, spider or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Website or any content listed therein, or in any way reproduce or circumvent the navigational structure or presentation of the Website or any content to obtain any documents or information through any means not specifically made available through the Website.

You acknowledge and agree that by accessing or using the Website and Services, you may be exposed to content from other users that you may consider offensive, indecent or otherwise objectionable. VPP disclaims all liabilities arising in relation to any offensive content on the Website. Further, you may report such offensive content in the manner prescribed herein.

If the Website allows you to post and upload any content or material on the Website, you hereby undertake to ensure that such content or material is not offensive and in accordance with applicable laws. Further, you undertake not to:

  • Defame, abuse, harass, threaten or otherwise violate the legal rights of others;
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
  • Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information through any bookmark, tag or keyword;

  • Disrupt or interfere with the security of, or otherwise cause harm to, the Website, systems resources, accounts, passwords, servers or networks connected to or accessible through the Website or any affiliated or linked sites;
  • Conduct or forward surveys, contests, pyramid schemes or chain letters;
  • Download any file posted by another user of a service that you now, or reasonably should know, cannot be legally distributed in such manner;

  • You agree that VPP has no obligation to monitor any contents or material uploaded by you on the Website. However, VPP reserves the right to review the contents or materials posted by you on the Website and to remove such contents in its sole discretion. VPP reserves the right to terminate the User’s access to any or all of the information provided by VPP at any time without notice for any reason whatsoever.
  • You agree that VPP reserves the right at all times to disclose any information as is necessary to satisfy or comply with any applicable law, regulations, legal process or governmental request, or to edit, refuse to post or to remove any information in whole or in part, in VPP’s sole discretion.
  • You agree that VPP may, at any time, modify or discontinue all or any part of the Website, charge, modify or waive fees required to use the website or offer opportunities to some or all Website Users.
  • You agree that you shall not use the Website or any information contained therein for any illegal purpose. You may not access VPP’s networks, computers, or the information and Services in any manner that could damage, disable, overburden, or impair them, or interfere with other person’s use and enjoyment.

Applicable Laws

The Agreement is published in compliance of, and is governed by the Provisions of Indian law, including but not limited to:

  • The Indian Contract Act,1872,
  • The Information Technology Act,2000 and
  • The rules, regulations, guidelines and clarifications framed there under, including the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules,2011 (the "SPDI Rules"), and Information Technology (Intermediaries Guidelines) Rules,2011 (the "IG Rules")

Changes

VPP may change or discontinue any aspect of its products, services, technology usage etc at any time, including content or features. VPP also reserves the right to change the terms and conditions applicable to its products, services, content etc. Use of the Services after such changes shall be deemed to be acceptance by User of such changes.

Accuracy Of Information & Warranty

The information contained in the VPP website has been created and obtained from sources believed to be reliable but VPP does not warrant the completeness, timeliness or accuracy of any information contained therein. The content on Website is intended to: help identify prospective business collaboration; business risks; provide insights based on industry research; and to help you focus on certain matters which may be affecting your business. VPP does not provide legal and/or accounting advice. We encourage you to seek professional advice whenever necessary.

VPP expressly excludes and disclaims all express or implied conditions, representations and warranties including, without limitation, any implied warranties or conditions to the extent allowable by law.

Although VPP takes reasonable steps to screen content on the website for infection by viruses, worms, Trojan horses or other code manifesting contaminating or destructive properties before making the same available, VPP cannot guarantee that any of the content on the website will be free of infection.

Limitation Of Liability

In no event is VPP/VIPL liable for any direct, special, indirect, consequential, incidental, punitive or other damages however caused, whether in contract, tort, negligence, strict liability, operation of law or otherwise, (including without limitation damages for lost profits, business interruption or loss arising out of the use of or inability to use the content, or any information provided in the content, or claims attributable to errors, omissions or other inaccuracies in the content in the website or interpretations thereof), even VPP has been advised of the possibility of such damages.

Used while browsing the VPP website if the Users goto any third-party sites, User must understand such third party sites are not under the control of VPP. VPP is not responsible for anything on these third party sites, including without limitation any content, links to other sites, any changes to those sites, or any policies those sites may have. VPP only provided content and by no means and imply the endorsement of such third party site by VPP.

Governing Law

This site and agreement is governed by the laws of New Delhi, India. Any legal action pursuant to the said Agreement shall be subject to the exclusive jurisdiction of the courts of the New Delhi, India.

Entire Agreement

These standard terms of use, together with any service agreements and statements of work signed by the parties, contains the complete and exclusive statement of agreement between the parties. These terms and conditions may not be modified except via written agreement signed by both parties.
